These terms apply to bookings made through Smile Casting Talent Agency for the artists we represent. They are written for the people who book our artists: casting directors, production companies, brands and agencies. Each artist has their own agreement with us, which is separate from this page.

Rates and agreements

Television and film. Bookings are paid according to the relevant agreement, such as BBC/Equity, ITV/Equity, PACT/Equity or FAA/PACT. Rates are as set out in that agreement at the time of booking.

Commercials, pop promos and corporate videos. Unless otherwise agreed, these are based on a 10 hour day, and overtime is paid at one fifth of the daily rate per hour. Night rates are negotiated according to the nature of the work. Featured artists are entitled to repeat fees or a usage fee, depending on the number of TVRs or the agreed usage.

Promotions. Paid at either a 5 hour or a 10 hour rate. Unless otherwise agreed, overtime is paid at one fifth of the daily rate per hour after 10 hours.

Photographic and voiceover work. Paid at an agreed hourly, half day or full day rate, plus an appropriate usage fee.

Usage

Usage fees cover the right to use the artist’s image, voice and performance. Once agreed, they are payable whether or not the right is exercised. Unless we agree otherwise in writing, no usage is permitted until payment is made in full.

Artificial intelligence and digital replicas

Artists are engaged to perform themselves. Their image, voice, likeness and performance must not be used to create or train a digital replica, synthetic performance or AI generated content, or be altered in a way that goes beyond the booking, without the artist’s specific written consent and an agreed fee. This applies to all bookings unless a written agreement says otherwise.

Agency fees

Our fees are agreed at the time of booking and shown on the invoice. Where work is shot or used outside the UK, an additional agency fee may apply. We will tell you what it is before you confirm the booking.

Invoicing and payment

Smile Casting invoices for both the artist’s fee and our own. Invoices are payable within 30 days of the invoice date. The person or company booking the artist is the client, is invoiced, and is responsible for payment unless we agree otherwise in writing at the time of booking.

We may invoice the ultimate client, such as the brand, manufacturer or owner of the product, where the booking is made on their behalf. In that case, the client and the ultimate client are jointly responsible for paying the invoice.

All payments should be made to Smile Casting on receipt of invoice. If you pay an artist directly, please tell us straight away so our accounts are correct. We may change payment terms before a booking is confirmed.

Smile Casting is not currently VAT registered. If that changes, VAT will be added to invoices where it applies.

If an invoice is not paid by the due date, interest will be charged on the amount outstanding at the statutory rate of 8% a year above the Bank of England base rate, under the Late Payment of Commercial Debts (Interest) Act 1998, from the due date until payment is made in full.

Cancellations

If a booking is cancelled after 5.30pm on the day before the booking, a cancellation fee will be charged at the artist’s basic daily rate.

Tax and National Insurance

Unless the engagement is paid through PAYE by the employer, artists are treated as self-employed and are responsible for their own Income Tax and National Insurance contributions. Where an employer engages an artist under PAYE, the employer is responsible for deducting tax and National Insurance.

Health and safety

On set, artists are the responsibility of the employer, who must observe all relevant health and safety legislation and standards. Failure by an artist to comply with an employer’s health and safety policy will be treated as a breach of the booking agreement.

Performers under 18

Bookings for performers under 18 are subject to the licensing and chaperone requirements and the working hour and rest limits that apply to children. The production company is responsible for obtaining any licence required. See our safeguarding and parents page for more.

Governing law

These terms are governed by the law of England and Wales.
